The Republicans obligingly failed to raise these essential questions about the individual mandate: "Is it necessary?" and "Is it proper?" In fact, it is neither. Government programs already paid for three-fourths of the uncompensated costs of uninsured people. It would only have been necessary to expand those programs to cover the rest. And it would have been cheaper. Actual health costs of the uninsured average less than $1800 a year, while the subsidies to buy health insurance policies are expected to cost around $5800 each. So, the individual mandate was not necessary to cover the uninsured; and it increases costs to the public, not reduces them, thus leaving less money for actual health care! It's time for a real attack on the Constitutionality of the individual mandate!
BUT - requiring the insurance companies to pay for goodies for some was a cynical gambit by the Obama administration to inflict financial hardships on the industry, while currying favor with the short-sighted. Then, they used those hardships that they imposed, unnecessarily, as the pretext for forcing people to buy policies to bail them out. And once enrolled, , all people would be in the clutches of the health fascists, who want to control the details of our personal lives, and whose pseudo-science is based on quackery, fraud and charlatanism! No escape would be possible, because those intrusions are a required part of every ACA-approved health insurance plan! The National Prevention, Health Promotion and Public Health Council will be chaired by the politician-appointed Surgeon General, whose every report on smoking has been suitable for a trial exhibit of scientific fraud. The Council members are the politician-appointed heads of other government departments, which will be enlisted into a monolithic health fascist policy juggernaut, with a politician-appointed Advisory Council which "shall develop policy and program recommendations and advise the Council on lifestyle-based chronic disease prevention and management, integrative health care practices, and health promotion."

As for who gets the biggest subsidy, exclusion of the cost of employer-paid health insurance cost the government $246 billion in lost revenue in 2007. $246B / 156 million people with private insurance = $1576 subsidy, while the $57 billion in uncompensated costs / 50 million uninsured people = $1140 each. And, "Although the tax exclusion provides a big boost to employer-sponsored health coverage, it is poorly targeted. It gives the greatest benefit to those with the highest incomes, although they are the group that least needs help paying for health insurance. The 24 percent of tax units with incomes over $75,000 in 2004 received almost half of the benefits of the exclusion, while the 27 percent of tax units with incomes under $20,000 received just 6 percent of the benefits." Pages 242-244, Individual Responsibility: The supposed Constitutional justifications for the individual mandate to buy health insurance don't even resemble any kind of Constitutional reasoning. They're just a mishmash of flimsy rationalizations, crassly promoting a single special interest, such as: It's a whole lot of money (as if the mere fact entitles the government to seize it from the citizens). Insurance is sold in interstate commerce (so the government can grab money that isn't in interstate commerce and isn't being used to buy insurance at all). It's a good thing because it will add millions of "consumers" (and whether they want it or not is treated as irrelevant), and increase the demand for health care services (which will cost additional money). It will prevent some personal bankruptcies due to medical costs (It will help some people, while others don't matter; nor do other reasons for personal bankruptcy, because they don't supply a pretext for this legislation.) The insurance companies must be protected from people who wait until they're sick to buy insurance (although it would have saved the taxpayers money to simply pay for health care for people with no money, while leaving those who can pay to do so). The citizens' rights must be sacrificed to serve the insurance companies claimed need for "economies of scale" (Why do people who are not their customers owe them anything? Next they'll demand we invade other countries to force them to join the risk pool). The Supreme Court ruled that insurance is interstate commerce subject to Federal regulation (so the government can just grab any money anywhere, because it might be used to buy insurance). This is breathtakingly moronic, and reads like the sales pitch of a pushy insurance salesman.
Forcing people to buy private health insurance is unprecedented in every way. It is also completely unnecessary for its supposed purpose of providing health care for the uninsured, because this program could have been funded in numerous other ways which are not unconstitutional. The real question is, WHY DIDN'T THEY DO IT RIGHT IN THE FIRST PLACE? It's clear from reading the bill that the real reason is so that they can shove their Nazi pseudo-science of "wellness" down everyone's throat. The "wellness" garbage would be a required part of every approved health insurance plan (pages 45-46). It includes government grants for employers to institute wellness programs, which rewards believers in health fascist pseudo-science with premium discounts of up to 50% (pages 155-158). These are a required part of every approved health insurance plan. (Essential Health Benefits Requirements, pp. 163-164.) Under the phony pretext of "prohibiting discrimination," it financially coerces people to submit to health fascist charlatanism and discriminates against anyone who refuses!
The bottom line is that the taxpayers have no financial interest whatsoever in coercing people to stop smoking or to lose weight. These things would not only not save health costs, to the extent that they worked, they would increase them. Because the truth interfered with their totalitarian agenda, the criminals in Congress deliberately created the fraudulent SAMMEC computer program to deceive the public with lying propaganda. The SAMMEC falsely pretends that costs paid by smokers were paid by society, that diseases caused by infection were caused by smoking, and that non-smokers' costs don't exist at all. Other promoters of health fascism, including the main architect of this health plan, simply pull an enormous arbitrary "value" for life out of their rear ends, and pretend that this is a cost to society!

"To claim the right not to buy health insurance is thus to
assert a right to impose enormous costs on others. Many legal scholars
insist that the Constitution guarantees no such right." (Giving Health

"a right to impose enormous costs on others," while ignoring the
subsidy to buy health insurance which is larger ($1600 versus $1100),
and benefits primarily the wealthy! And it's an outrageous swarm of
lies. In the real world, there are many people who are too poor to be
able to pay for their health care, including 90% of the uninsured.
Health insurance is such an inefficient mechanism for paying for health
care that they are even less able to afford that, and the subsidy
necessary to enable them to buy it places an even more enormous cost on
others. And, those who could afford to buy it but decline on the
grounds that the more money is wasted on health insurance, the less
there is for actual health care, are entirely correct. Some of whom are
physically and mentally disabled, and will never be able to pay. Is the
government entitled to impose on them a duty which they haven't the
slightest ability to fulfill, under the pretext that they're harming
others? Ultimately, it leads to the specious conclusion that poor
people have no right to exist in the first place, and may be terminated
by the government with impunity, because all their other rights are
contingent upon their right to exist anyhow. This is how they thought
in Nazi Germany. And this is exactly where the sophists and
pettifoggers they call "legal scholars," as exemplified by President
Obama and the Harvard Law School that spawned him, want it to go.
The Government's sorry excuse for a Constitutional argument in
defense of the so-called "minimum
coverage provision" reads as if it's prosecuting the poor
people for being poor. Its true aim of using our tax dollars to promote
the interests of the insurance industry is transparently obvious, as is

The new Tobacco Products Scientific Advisory Committee of the Food and Drug Administration is chaired by the same fraudster, Jonathan M. Samet, Harvard 1966, who has ring-led every previous major anti-smoker initiative. Jon Samet has been an anti-smoking activist since the Fifth World Conference on Smoking and Health in 1983. He was one of three "consulting scientific editors" and "prepared draft chapters or portions" of the 1986 Surgeon General Report, "The Health Consequences of Involuntary Smoking," and was also involved in the 1984, 1985, 1989, 1990, 1994, 1998, 2000, 2001 and 2004 SG Reports, and was Senior Scientific Editor of the 2006 Surgeon General Report, "The Health Consequences of Involuntary Exposure to Tobacco Smoke." He was also a member of the Science Advisory Board of the so-called "EPA" Report on ETS, the key chapters of which were actually secretly written by an anti-smoking activist crony of Samet's, using illegal pass-through contracts to conceal his role. Samet was Chairman of the IARC (International Agency for Research on Cancer) committee which produced the fraudulent Monograph on Smoking and Involuntary Smoking in 2003. In 2005, Samet and three anti-smoking activist cronies formed a majority of the voting board of the ASHRAE Position Document on ETS. In addition, he committed perjury in 1998 in the State of Minnesota lawsuit against the cigarette companies, and testified in the US Department of Justice lawsuit against them as well.
